TERMS OF USE (ToU) – COBBR APPLICATION

1. DEFINITIONS

The Cobbr application allows its users (hereinafter referred to as the Runner) to send a unique link to users (hereinafter referred to as Supporters) so they can record a voice message to play at specified kilometres.

Runner: A natural person registered on the application who creates a race profile.

Supporter: A natural person who uses a unique link to record a message, with no obligation to create an account.

Content: Any voice message, text, or image uploaded to the application.

2. ACCESS AND REGISTRATION

For the Runner: Registration is required to create a race and generate a sharing link. The Runner undertakes to provide accurate information. The Runner may use a nickname.

For the Supporter: Access is via a unique link. No account is required to leave a message, which makes spontaneous use easy.

Acceptance of terms: Access to the Application’s services is subject to express, unreserved acceptance of these ToU.

For the Runner: Acceptance is given by ticking a dedicated box when creating the account.

For the Supporter: Although they do not create an account, the Supporter must tick a box accepting the ToU and consenting to the recording of their voice before sending their message. Without this validation, the recording cannot be sent.

3. INTELLECTUAL PROPERTY AND VOICE RIGHTS

By using the application, the user accepts the following:

Recording consent: The Supporter expressly agrees that their voice may be recorded and played to the Runner via the application.

Licence to use: The user grants Cobbr a free, worldwide licence to host, store, and transmit voice messages strictly within the scope of the service.

Private use: Messages are intended for personal, private use in the context of the race.

4. MODERATION AND LIABILITY

Unlawful content: It is strictly forbidden to record messages that are abusive, defamatory, racist, or that infringe human dignity. Any report may result in the user being banned without notice.

Responsibility for the link: The Runner is responsible for sharing their unique link. The publisher cannot be held liable if unwanted persons access the link and leave messages.

Removal: Cobbr reserves the right to remove any content reported as inappropriate or unlawful, without notice.

5. PERSONAL DATA PROTECTION (GDPR)

In accordance with the GDPR:

Data collected: Email, profile data, and metadata (playback kilometre) for the Runner; voice recordings and metadata (playback kilometre) for the Supporter.

Purpose: Provision of the deferred voice messaging service.

Retention: Voice messages are kept for 30 days after the race, unless the Runner chooses to archive or delete them manually.

Rights: Each user has the right to access, rectify, and erase their data via: team@cobbr.app

Transfer of data outside the European Union: The User is informed that the data collected (including audio files and profile data) is hosted on servers located in Ireland (EU) via the provider MongoDB, and in Europe via the provider Amazon Web Services.

6. SERVICE AVAILABILITY

The publisher strives to ensure optimal availability, especially during peak usage (major race days). However, it cannot guarantee that there will be no interruptions related to mobile networks or maintenance.

7. PRESENTATION OF THE APPLICATION

The Cobbr application is published in France by Julie, residing at 17 rue Poliveau, 75005 Paris. The application lets runners receive voice messages of support from their loved ones during a sporting event.

8. APPLICABLE LAW

These ToU are governed by French law. In the event of a dispute, and after an attempt at mediation, the courts of Paris shall have exclusive jurisdiction.
